1. About These Terms
These Terms & Conditions ("Terms") govern the use of the Drone Inspections WA (DIWA) website (diwauav.com.au), and the provision of DIWA's drone services, including but not limited to UAV inspections, LiDAR and 3D mapping, ground-penetrating radar (GPR) surveys, environmental and thermal surveys, agricultural spraying and seeding services, drone consultancy, and the sale of products through our online shop.
By accessing this website or engaging DIWA for services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
2. About DIWA
Drone Inspections WA (DIWA) is a Perth, Western Australia based drone operations business, operating under a CASA (Civil Aviation Safety Authority) Remote Operator's Certificate (ReOC), providing commercial drone services across the mining, infrastructure, environmental, agricultural, and defence sectors.
3. Our Services
DIWA provides commercial drone services including, but not limited to:

All flight operations are conducted in accordance with CASA regulations and DIWA's approved Operations Manual under our ReOC.
4. Quotes, Bookings & Payment
4.1 Quotes provided by DIWA are estimates based on information supplied by the client and are subject to change if the scope of work changes.
4.2 A booking is confirmed only upon written acceptance by DIWA and, where applicable, payment of any required deposit.
4.3 Payment terms will be specified in the applicable quote or invoice. Late payments may incur interest or additional fees as permitted by law.
4.4 Product purchases made through our online shop are subject to the payment terms displayed at checkout.
5. Site Access, Safety & Client Obligations
5.1 The client must provide safe and reasonable access to the site(s) where services are to be performed, including any permissions, landowner consent, or site inductions required.
5.2 The client is responsible for disclosing any known hazards, restricted airspace considerations, or site-specific risks prior to the commencement of operations.
5.3 DIWA reserves the right to postpone, reschedule, or cancel a flight where weather, airspace restrictions, safety concerns, or regulatory requirements make it unsafe or non-compliant to proceed.
5.4 For agricultural spraying and seeding services, the client is responsible for providing accurate information regarding the substances to be applied, target areas, buffer zones, and any regulatory approvals required for the specific chemicals or seed being used.
6. Data & Deliverables
6.1 Data collected during operations (imagery, LiDAR point clouds, GPR data, reports, etc.) will be delivered in the format agreed with the client.
6.2 DIWA will take reasonable care in the collection and processing of data but does not guarantee outcomes dependent on factors outside its control (e.g. weather conditions affecting data quality, third-party equipment limitations).
6.3 Unless otherwise agreed in writing, DIWA retains ownership of raw flight data and grants the client a licence to use processed deliverables for their intended business purpose.
6.4 Data will be retained and/or disposed of in accordance with DIWA's data retention policy and any applicable privacy legislation.
7. Intellectual Property
All website content, branding, reports, and deliverables produced by DIWA remain the intellectual property of DIWA unless otherwise agreed in writing or explicitly transferred as part of a service agreement.
8. Liability & Insurance
8.1 DIWA holds public liability insurance appropriate to its operations. Certificates of currency are available on request.
8.2 To the maximum extent permitted by law, DIWA's liability for any loss or damage arising from the provision of services is limited to the value of the fees paid for the specific service giving rise to the claim.
8.3 DIWA is not liable for indirect, consequential, or economic loss arising from delays, data limitations, or circumstances beyond its reasonable control (including adverse weather, airspace restrictions, or third-party interference).
8.4 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded.
9. Cancellations & Rescheduling
9.1 Cancellations by the client with less than [X] hours' notice may incur a cancellation fee, as specified in the relevant quote or service agreement.
9.2 Where DIWA must cancel or reschedule due to weather, safety, or regulatory reasons, no cancellation fee will apply and a new date will be arranged.
10. Shop / Product Purchases
10.1 Products sold through the DIWA online shop are subject to availability.
10.2 Returns, refunds, and warranty claims for products will be handled in accordance with Australian Consumer Law and any manufacturer warranty terms.

11.1 Content on this website is provided for general informational purposes and does not constitute professional or legal advice.
11.2 DIWA reserves the right to update website content, including these Terms, at any time without prior notice.
12. Privacy
